RapidRoad Assist – Terms & Conditions

Welcome to RapidRoad Assist. These Terms & Conditions ("Terms") govern your membership in RapidRoad Assist ("the Company", "we", "our") and your use of our roadside assistance services ("Services"). By signing up, paying membership fees, or using our Services, you agree to be legally bound by these Terms. Please read them carefully.

Definitions

Member/You

Person whose application is approved by the Company and whose membership fee is paid.

Membership

Subscription plan for a fixed term (e.g., 12 months).

Monthly Fee

R109 or as published, payable monthly in advance.

Commitment Period

Non-cancellable duration of the Membership (minimum 12 months).

Waiting Period

Two-month (60-day) period during which claims are not permitted.

Services

Roadside assistance (towing, battery jump-start, tyre change, fuel delivery, locksmith, security, etc.) as detailed on our website.

Service Provider

Independent contractor providing Services on our behalf.

Debt Collectors

Third-party agencies engaged to recover outstanding amounts if Member fails to pay as required.

Outstanding Amounts

Unpaid Membership fees or Service charges.

Membership & Fee Obligations

Fixed-Term Membership

Upon successful signup and first payment, You commit to the full Commitment Period. Membership cannot be canceled without settling the full remaining balance.

Payment

Membership fees are payable monthly in advance via EFT, debit order, or credit card according to our sign-up page.

Late or Skipped Payments

  • If a payment fails or is fourteen (14) days overdue, we will notify You.
  • You will be added to the Debt Collection process should payment not be received within a total of thirty (30) days.

Early Cancellation by Member

  • You remain liable for the full remaining balance of the Membership.
  • This outstanding balance will be immediately due and payable or handed to Debt Collectors if unpaid within fourteen (14) days.
  • Early cancellations may incur a cancellation fee at the discretion of the Company to cover administrative, processing, and service reservation costs. This fee will be communicated prior to the cancellation being finalized.

Automatic Renewal

After the Commitment Period, Membership renews automatically monthly. Terms apply until You give us 60 days' written notice.

Waiting Period & Claim Eligibility

Members must complete the waiting period before making claims

Waiting Period

Members must pay two (2) full monthly fees before any claims are allowed.

Third Payment Condition

Upon payment of the third month's fee, You become eligible to make a single roadside assistance claim during that month.

Post-Eligibility Service Use

After claiming, You remain eligible for subsequent service requests during Membership, subject to benefit limits in clause 5.

Services, Coverage & Limits

Scope of Services

Includes towing (first 10km only, additional kilometers for Member's account), tyre changes up to two flat tyre's every 6 months, fuel delivery (up to 5L), battery jump-start, locksmith assistance, security escort, fluid replacement.

Service Limitations

  • One claim per third month unless risk mitigators (e.g., incident reports, or prior approval) are applied.
  • Emergency exclusions include: collision damage, mechanical breakdown (except jump-start), acts of God, unfit vehicles, misuse, illegal activities.
  • No Monetary Compensation: Claims only entitle You to Services. Under no circumstances will You receive cash refunds or reimbursements.

Liability & Indemnification

Liability Notice

Please review the limitations of our liability carefully

Service Quality

We engage reputable providers. However, we do not guarantee availability or timeliness.

No Liability for Damages

The Company is not responsible for indirect, consequential losses, vehicle damage, third-party claims, or uninsured under-service.

Indemnity

You hereby indemnify and hold the Company, the Service Provider, or Debt Collectors harmless against all claims, liabilities, damages, costs, expenses (including legal fees) arising from Your:

  • Misrepresentation
  • Misuse of Services
  • Criminal activities
  • Breach of these Terms

Defaults, Suspension & Cancellation

Default

Defined as non-payment of fees or breached Terms.

Suspension

We may immediately suspend Services without prior notice if You remain in default for seven (7) days.

Debt Collection

Unpaid fees or claim amounts after 14 days will be referred to Debt Collectors. Associated fees and interest may be added.

Cancellation by Us

In case of fraud, repeated default, abusive use, or breach of these Terms, we reserve the right to cancel Membership and refer You to Debt Collectors.

Member Obligations & Cooperation

Accurate Information

You warrant your contact details and payment information are current and accurate.

Prompt Response

Refrain from placing multiple or vexatious claims. Cooperate with claim validation, including providing location, registration, place, service request details.

Use of Services

Services requested and provided will only be delivered as described on our website, absent liability beyond those Services.

Privacy, Data & Communication

Data Protection Notice

Your privacy is important to us

We will collect and process your personal data per our posted Privacy Policy.

Your personal data may be shared with Service Providers and Debt Collectors as reasonably necessary.

You consent to SMS, WhatsApp, email, or phone communication for payment reminders, claim status, and marketing.

Amendments & Interpretation

We reserve the right to modify these Terms, Membership fees, Services, or Waiting/Commitment structure.

Changes will be notified 30 days in advance via email or your preferred communication channel.

Governing Law & Dispute Resolution

These Terms will be governed by the laws of the Republic of South Africa.

Any dispute shall first be referred to mediation. If resolution fails within 30 days, the dispute will be referred to arbitration under the rules of the Arbitration Foundation of South Africa in Johannesburg.

Consumers have the right to approach the National Consumer Commissioner (NCC) if matters cannot be resolved amicably.
